Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Right of withdrawal: The period during which the consumer may exercise their right to cancel the purchase.

Consumer: A natural person not acting in the course of a profession or business, who enters into a distance sales contract with the seller.

Day: Calendar day.

Open-ended contract: A distance sales agreement relating to a series of products and/or services for which the obligation to deliver or purchase is spread over time.

Durable data carrier: Any tool that allows the consumer or seller to store information addressed personally to them in a way that enables future consultation and unchanged reproduction.

Right of cancellation: The ability of the consumer to terminate the distance sales agreement within the specified withdrawal period.

Seller: The natural or legal person who offers products and/or services to consumers at a distance.

Distance sales contract: An agreement concluded within the framework of an organized system for selling products and/or services at a distance, where one or more remote communication methods are used up to and including the conclusion of the agreement.

Remote communication method: A means that can be used to conclude an agreement without the consumer and seller being physically present in the same location.

Article 3 – Applicability

These terms apply to all offers from the seller and all distance contracts concluded between the seller and the consumer.

Before the distance contract is concluded, the text of these terms will be made available to the consumer. If this is not reasonably possible, it will be indicated where the terms can be reviewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, these terms will also be provided in a format that allows the consumer to store them on a durable data carrier.

In case of a conflict between these general terms and specific product or service terms, the consumer may always rely on the provision that is most favorable to them.

If any provision of these terms is found invalid or annulled, the remaining provisions will remain in full effect.

Article 4 – The Offer

If an offer has limited validity or is subject to conditions, this will be clearly stated.

The offer includes a complete and accurate description of the products and/or services offered. Accompanying images are a truthful representation.

Each offer includes sufficient information so that the consumer clearly understands their rights and obligations, including price, shipping costs, payment, delivery, and execution conditions.

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and its conditions.

If the consumer accepts the offer electronically, the seller will confirm receipt of the acceptance without delay. Until receipt is confirmed, the consumer may cancel the agreement.

If the contract is concluded electronically, the seller will implement appropriate technical and organizational measures to ensure secure data transmission and website safety. For electronic payments, suitable security protocols will be used.

The seller may gather information (within legal bounds) about the consumer's ability to meet payment obligations and relevant risk factors. If the seller has legitimate reasons not to conclude the agreement, they may refuse the order or attach special conditions.

Article 6 – Right of Withdrawal

The consumer may cancel the purchase within 30 days without providing any reason. This period starts on the day after the consumer receives the product.

During the withdrawal period, the consumer must handle the product with care. The product must be returned in perfect condition and in its original packaging.

The consumer must notify the seller in writing within 30 days of the intention to withdraw and return the item within the same period.

Return shipping costs are the responsibility of the consumer.

Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the return shipping costs (including international shipping if applicable) are fully the responsibility of the consumer.

If payment has already been made, the seller will issue a refund within 30 days of receiving the returned items.

Article 8 – Exceptions to the Right of Withdrawal

The seller may exclude the right of withdrawal for the following:

  • Products made to the consumer’s specifications

  • Clearly customized products

  • Items that cannot be returned for hygiene reasons

  • Newspapers, magazines, and periodicals

  • Sealed software, CDs, and DVDs that have been opened

Exclusions must be clearly stated before the contract is concluded.

Article 9 – Pricing

Prices will not be increased during the validity period of an offer unless due to VAT changes or external factors.

Market fluctuations may lead to price changes for certain products, which will be clearly indicated if applicable.

All prices are subject to typographical errors. The seller is not obligated to deliver a product at an incorrect price.

Article 10 – Conformity and Warranty

The seller guarantees that the products and services comply with the agreement, the specifications in the offer, and applicable legal standards.

Any defects or shortcomings must be reported by the consumer within 30 days of delivery.

The warranty does not cover damage caused by improper use or failure to follow instructions.

Article 11 – Delivery and Execution

The seller will exercise the utmost care in processing orders and delivering products.

Delivery time shall not exceed 30 days unless otherwise specified. If a delay is expected, the consumer will be notified promptly.

Article 12 – Contract Duration and Termination

Contracts for the ongoing delivery of goods or services may be terminated by the consumer with a notice period of no more than one month.

Fixed-term contracts may not be automatically renewed unless specific exceptions apply.

Article 13 – Payment

The consumer must make payment within 7 business days, unless otherwise agreed.

Late payments may result in additional fees charged to the consumer.

Article 14 – Complaints Handling

All complaints must be submitted within 7 days of receiving the product.

The seller commits to addressing complaints within 30 days and providing a satisfactory resolution.

Article 15 – Disputes

Contracts between the seller and consumer that fall under these general terms are governed exclusively by Dutch law, even if the consumer resides abroad.
